Damage Assessment for Intangible Property
The complexity of calculating property losses in business is similar to analyzing a system with multiple degrees of freedom.
The defendant’s attorneys, above all else, always challenge the existence of a causal link between the tort and the property damages. When the plaintiff’s attorney manages to establish a high likelihood of the former, the extent of the damage (including the method of calculation and data reliability) is strongly contested.
Polish courts usually reject damage calculations that include forecasts, even if these forecasts are prepared logically, follow good practice, and are based on the information available at the time of the tort and for a reasonable period during which the negative effects of the tort on the plaintiff’s property are highly likely.
When it comes to infringement of intangible property, cases can drag on for years, not only because of court overload.
In my publications, I examine the principles and methods of damage valuation, focusing on those that have worked in my experience as a court expert and could be useful in the Polish justice system, as they have been adopted in the practices of court experts in other countries. This experience has motivated me to develop and test my own investment strategies. I rarely buy stocks unless necessary. If I hold a long position in stocks, I either sell them as quickly as possible or build a portfolio with the appropriate risk-return profile by adding options.
